Appellate practice is multi-faceted, and involves different skills and strategic considerations than trial practice. Appellate practitioners, however, can play a role at the trial court level by working with the trial team to ensure that appealable issues are raised and preserved at the trial court level. Once the trial is over, appellate counsel will undertake the necessary steps to initiate the appeal of an adverse ruling or outcome, and define appeals of questionable outcomes. After the appeal has been filed, appellate attorneys review and analyze the trial court records and other documents, examining the issues in light of the procedural and policy considerations shaping the law.
