LDM Attorney Secures Nebraska Supreme Court Victory After Prior Appellate Setback

Lamson Dugan & Murray partner Cathy Trent-Vilim, working with partner John Walker, recently secured a significant appellate victory before the Nebraska Supreme Court in a property possession dispute involving a complex procedural issue and questions regarding the limits of county court jurisdiction.

LDM was brought into the matter after the client had already lost at the trial court level and again at the first level of appeal. The initial appeal was not decided on the merits. Instead, the appellate court declined to consider the client’s arguments because of a procedural issue involving the appellate record.

After being retained, Cathy and John sought to correct the record so the appellate court could consider whether it had jurisdiction to hear the case. When that request was denied, they appealed to the Nebraska Supreme Court.

To prevail, LDM had to overcome a difficult appellate standard. Cathy and John argued that the lower appellate court abused its discretion by refusing to allow the record to be corrected, because the complete record was necessary for the court to determine whether subject matter jurisdiction existed. They also had to show that the underlying dispute involved questions of title or legal or equitable rights in the property itself, which could not be decided through a forcible entry and detainer action.

The Nebraska Supreme Court agreed. The Court vacated the district court’s judgment and remanded the matter with directions to vacate the county court judgment and dismiss the forcible entry and detainer complaint for lack of subject matter jurisdiction.

The decision is an important reminder that procedural issues can be outcome-determinative on appeal, but also that courts have an independent obligation to examine jurisdiction. It further reinforces that when a property possession dispute requires a court to determine legal or equitable rights in the property itself, the matter must be addressed in the proper forum and through the proper form of action.
