Nebraska Court of Appeals Reverses Summary Judgment in Construction Dispute

Lamson Dugan & Murray LLP attorneys Tevyn L. Waddell and Craig F. Martin recently secured an important appellate result before the Nebraska Court of Appeals.

In an opinion filed June 23, 2026, the Court of Appeals reversed a district court order granting summary judgment in a construction-related dispute and remanded the matter for further proceedings.

The appeal involved questions regarding whether summary judgment was appropriate where factual disputes remained concerning the work performed, the parties’ conduct during the project, and whether the matter should proceed beyond the summary judgment stage.

The Court of Appeals agreed that genuine issues of material fact remained and concluded that the district court’s order should be reversed.

The decision does not resolve the underlying claims, but it allows the matter to continue in the district court.

The appeal also marked a professional milestone for Waddell, who delivered her first oral argument.
