LDM Secures Summary Judgment for Insurance Agent and Agency in Iowa Professional Negligence Case
On June 30, 2025, the Iowa District Court for Polk County granted summary judgment in favor of Lamson Dugan & Murray LLP’s clients—an insurance agent and insurance agency—effectively dismissing all claims in a professional negligence lawsuit.
Attorneys Janice Thomas and Ryan Tunink represented the defendants in a case where the plaintiffs alleged two primary failures: (1) that the agent and agency did not procure an excess underinsured motorist (UIM) policy, and (2) that they failed to execute a rejection of uninsured/underinsured motorist (UM/UIM) coverage. UM/UIM coverage provides financial protection to policyholders in the event they are involved in an accident with a driver who has insufficient or no insurance.
The Court found that the agent and agency did, in fact, procure the requested excess UIM policy and held that Iowa law does not require insurance agents to execute rejections of UM/UIM coverage on personal umbrella policies. Based on these findings, the Court dismissed all claims against LDM’s clients.
