LDM Attorneys Help Secure Nebraska Supreme Court Win for Insurance Agency Client

Lamson Dugan & Murray LLP attorneys Sean Minahan and Cathy Trent-Vilim recently helped secure an important appellate win for an insurance agency client before the Nebraska Supreme Court.

The decision affirmed summary judgment in favor of the insurance agency client in an errors and omissions defense matter involving claims related to insurance coverage for property damage. The appeal centered on whether the plaintiffs could proceed with a negligent misrepresentation claim against the agency.

At the trial court level, Minahan helped secure summary judgment for the client. On appeal, Trent-Vilim argued before the Nebraska Supreme Court, which affirmed the lower court’s decision.

In its opinion, the Court concluded that the plaintiffs had not presented evidence that the insurance agency or its agent made the alleged representation at issue. As a result, the negligent misrepresentation claim was properly dismissed as a matter of law.

The result reflects LDM’s experience defending insurance professionals and navigating complex professional liability and coverage-related disputes at both the trial and appellate levels.
